The NA’s special commission for the review of the laws of the Popular Power held its first session

Caracas, November 1, 2022 (Press MinComunas) – This Tuesday took place the first session of the special commission of the National Assembly (AN) for the revision of the laws of the People’s Power, with the participation of the Minister for Communes and Social Movements, Jorge Arreaza, vice ministers and other authorities of this office.

Deputy Blanca Eekhout, president of the Permanent Commission for the Development of the Communes of the National Assembly, hosted the opening. She highlighted that this commission arises from an orientation of Jorge Rodriguez, President of the National Legislative Power, assuming a request of the Head of State, President Nicolas Maduro, at the ceremony for the 10th anniversary of the Coup de Timon last October 20, from the Commune El Maizal, in Lara State.

He stressed that revision and reforms of the laws are only possible with the active participation of the communal people and the Ministry of the area and that it is a matter of harmonizing the entire group of laws approved at different times and contexts related to the People’s Power, considering the experience gathered by the communal organizations, the technological developments that provide more efficiency, to guarantee that they are effective instruments in the construction of the commune’s State.

Eekhout detailed that they are considering the revision and adaptation of 12 laws, two of which are the projects approved in the first discussion of the Law of Communal Cities, with ten articles approved, and the Law of the Communal Parliament.

The Organic Law of the Communal Councils, Organic Law of the Social Comptrollership, Organic Law of the Communal Economic System, Organic Law of the People’s Power, Organic Law of the Communes, Law of the Federal Council of Government, Organic Law of Public and Popular Planning, Organic Law for the Management of Powers and Other Powers of the People’s Power, Organic Law of the Special Jurisdiction of the Communal Justice of Peace, Law of Communication of the People’s Power and the Law of the Local Committees of Supply and Production, and other instruments mentioned and are under revision; along with the Legal Consultancy of the Ministry for Communes.

Minister Jorge Arreaza pointed out that the instruction of President Nicolas Maduro not only encompasses the specific laws of the People’s Power. It goes beyond: How the Venezuelan legal system adapts to the demands of the communal power, which gathers reviewing the operation of the State, the interconnected laws with the People’s Power operations and related instruments.

He mentioned that in all this legal adaptation work, we have to consider the capacity of the Communes to generate self-government, co-management, and social control; from the Communes and the Communal Councils, the revolutionary Government policies are on a territorial basis. The strengthening of the communal economic circuits to retract the capitalist model and the spheres of action of these organizations in social production, economy for life, and commune’s management of public services.

He also specified that this is a law reform and the methods of government. He mentioned that President Maduro instructed the installation for the consultation of a table of the People’s Power spokespersons. They must try to design an instrument to measure how the laws were necessary and what they could apply or not of their articles to establish a consultation method that allows gathering information from the bases with technology. He also indicated that the revision should take into account the regulations of the pending organic laws.

Proposals for revision

Deputy Pedro Infante, first vice-president of the Permanent Commission for the Development of the Communes of the NA, praised the coordination between the Executive-Power and the Executive-Power this revision entails. According to the broader strategic vision offered by Minister Arreaza, more laws must be included, such as the new Law of Entrepreneurship and those related to public services. He stressed the importance of convening a national consultation day or round table because the work’s essence is the participation of communal power. He also proposed the formation of a team to build methodological terms on to work and the instruments for the public consultation to be digitally applied.

Deputy Juan Carlos Aleman, president of the Commission of People’s Power and Communication, with Gabriela Peña, another member of Congress, presented the proposal to reform the Law of Social Comptrollership. The proposal is designed to fight corruption and proposes eight articles revision and the creation of one. This proposal is already in the hands of the board of directors of the National Assembly.

On October 26, the Special Commission for the Transformation of the Laws of the People’s Power was installed.

Peña added that they considered the norms of citizen participation of the Office of the Comptroller General of the Republic and the power granted by decree to the health committees to exercise social comptrollership. It constitutes the third sphere of operation of the People’s Power, after planning public policies and the commune’s economy. They also considered that the Communal Councils and the Communes are instances of State.

Finally, Deputy Ricardo Molina presented the revision of the Decree with Rank, Force, and Value of the Organic Law of Public and Popular Planning of 2010, establishing a national planning system, an integrated system of strategic plans by levels, and operations which have no connection. In this sense, “we propose a transformation in the National Planning System, where the five levels are obliged by law to interconnect.”
